This bill amends the Utilities Code to establish generation reliability requirements for certain electric facilities in the ERCOT region. By January 1, 2027, the commission will set a single reliability standard requiring facilities to operate at no less than 50% of their nameplate capacity. Facilities can meet this standard by pooling resources with others in the same load zone. Facilities that opt out will have a settlement price cap of $50 per megawatt-hour in 2027, decreasing to $30 by 2037. Real-time settlement prices shall not fall below $0 per megawatt-hour. Violations of the reliability standard result in financial penalties, while revenues and penalties affect billing to Retail Electric Providers. The bill takes effect September 1, 2025.
