CITY OF HORSESHOE BAY: Public Hearing Set to Board of Adjustment for Application to Appeal Zoning Administrator Decision

City of Horseshoe Bay issued the following announcement.

An applicant has requested that the decision by the City Zoning Administrator denying the construction of a fence on a vacant property on Lighthouse Drive be reversed.  There will be a public hearing by the Horseshoe Bay Board of Adjustment (BOA) on Thursday, August 27, 2020 beginning at 3:00 PM, concerning that Application for an Appeal to reverse the decision by the Administrative Official (Zoning Administrator) regarding interpretation of the definition in Chapter 14 Zoning, Article 14.02 Zoning Ordinance, Section 14.02.002 “Definitions” of an Accessory Structure requiring that it be “located on the same lot as, the use of the main building…”.  The Zoning Administrator has denied the applicant’s request to place a fence on a vacant lot on Lighthouse Drive on the basis that there is no main building on the property. The hearing is being requested pursuant to Chapter 14 Zoning, Article 14.02 Zoning Ordinance, Section 14.02.192 requiring “the concurring vote of at least seventy-five percent (75%) of the full BOA (4 of 5) is necessary to reverse an order, requirement, decision or determination of an administrative official”.

The public hearing will be held at the City Council Chambers, #1 Community Drive, Horseshoe Bay, Texas 78657.  Contact the City Development Services Deparment office at 830-598-9906 for more information, or to comment regarding this application any time before the meeting or at the public hearing.  The meeting will also be held via virtual meeting.  Instructions for joining the virtual meeting will be posted with the Agenda for the Board of Adjustment at least 72 hours prior to the meeting.  Sign up for Agenda Center notices using the Civic Ready button on the homepage at www.horseshoe-bay-tx.gov to be notified when agendas are posted to the public.
