U.S. Representative Chip Roy has filed a resolution urging Vice President Kamala Harris to convene the Cabinet and declare President Joe Biden incapable of carrying out his duties as Commander-in-Chief. The resolution came the day after Biden’s performance in a presidential debate with Donald Trump.
"I put forth a resolution calling upon the Vice President to immediately use her powers under section 4 of the 25th Amendment to convene and mobilize the principal officers of the Cabinet to declare the President of the United States is unable to successfully discharge the duties and powers of his office," the resolution states.
The resolution also asserts that Biden has "repeatedly and publicly" demonstrated that he is not fit to carry out his presidential duties, including as commander-in-chief.
According to an Associated Press report, in an interview with CNN on Friday, Harris remarked on Biden’s debate performance: "It was a slow start. That’s obvious to everyone. I’m not going to debate that point."
According to Newsweek, discussions about using "section 4 of the 25th Amendment" to remove Biden from office have circulated in Congress since Thursday night’s debate ended. House Speaker Mike Johnson commented that if he were in Biden's Cabinet, "I would be having that discussion with my colleagues at the Cabinet level."
