Chip Roy urges preservation of evidence in DC abortion case

Representative Chip Roy, Chairman of the Judiciary Subcommittee on the Constitution, has taken steps to ensure the preservation of evidence in cases concerning abortion practices in Washington, D.C. Roy has specifically requested that authorities preserve the remains of five babies allegedly killed in illegal late-term abortions and retain information related to prosecutions of pro-life advocates.

Reports indicate that the Department of Justice advised the Washington, D.C. Medical Examiner to dispose of these remains, which were recovered from the Washington Surgi-Clinic in March 2022. This request follows an earlier one made by Representative Roy, which D.C. authorities have not yet addressed.

In a letter, Chairman Roy stated: “Future congressional investigations into potential violations and the sufficiency of existing law will undoubtedly be hampered if these remains and any related evidence are destroyed. These children deserve justice, regardless of which administration is in power."

Roy also urged Attorney General Merrick Garland and FBI Director Christopher Wray to maintain all evidence linked to their agencies’ enforcement of the Freedom of Access to Clinic Entrances (FACE) Act. He highlighted concerns that the Biden-Harris Administration might have disproportionately targeted pro-life individuals under this act.

Chairman Roy emphasized: “Accordingly, we formally request that you preserve all existing and future records and materials relating to FACE Act cases as part of our oversight of the use of this law."
